Apple Can Seek Ban on Samsung Smartphones in US, Court Says

Apple (APPL) can demand a ban on certain Samsung smartphones which comes under the patent breaching violation says jury while hearing Apple Samsung lawsuit.

The patent filled by Apple covers a range of touch screen technology that the Cupertino based giant says is unique to iPhone. The jury ruled that Apple can ask for bans for those Samsung smartphone which have copied Apple’s touch screen feature by there is a catch. Apple will have to prove that those perticuler technologies were the key factors in the sale of Samsung smartphone.

The two electronic major of the world are battling for $327 million dollar patent feud over Apples touch screen technology like multi touch, slide screen and bounce back features.

However $327 amount may be trifling the companies who makes most profitable smartphone in the world but the feud more much more than just money.

Apple’s smartphone and tablet sale has seen a drastic fall in last two years as Samsung emerged to claim the number one spot. In its patent filling Apple says that Samsung has enjoyed such successive sell on Apple’s expenses by copying its technology.

Samsung on the other hand agrees that it has copied Apple’s technology but it denies the claim that those features were the deciding factors in the sales of Samsung products.

Last year a jury found 26 Samsung models that infringe Apple’s patent iPhone, iPad technology and ordered Samsung to pay 1 billion dollars to settle the case. However some members of jury found that the numbers were miscalculated and Samsung and Apple met in the court again to battle for $327 million dollars.

However, the money involve in the case is less than the amount apple probably makes in one week of iPhones sells the company is keen to beat Samsung in the court. The ongoing case is just a warm up exercise for both companies as real battle is going to begin next year when Apple will fight Samsung in court for new patents in smartphone and tablet.
